Respondents Petition filed under Article 226 of the Constitution of India praying for issue of Writ of Mandamus directing the respondents to take necessary legal measures to set up the health center in the place allotted by the 8th respondent within the time frame fixed by this Court and till such time not to take any action to vacate the peripheral health center from the place where it is functioning at present.

ORDER

(Order of the Court was made by The Hon'ble Chief Justice) Petitioner filed the Public Interest Litigation alleging that the Health Centre was being shifted from Shop No.4 of Panchayat Commercial Complex, Pallikkaranai without creating an alternative Centre. Status quo was granted, as per the interim orders passed on 09.02.2011.

2. Counter-affidavit has been filed by respondent No.3 stating that the Health Sub Centre, Pallikkaranai will not be closed in view of vacating the Commercial Complex as alleged by the petitioner, but, the Sub Centre will be shifted to any other rented building, for which necessary action is being taken by the Block Medical Officer, Upgraded Primary Health Centre, Medavakkam and the health care services will be continued as usual.

3. The aforesaid statement is taken on record and shall be adhered to i.e. health facilities would thus continue to be made available to the concerned people at one of the location.

4. The writ petition, accordingly, stands disposed of. No costs.
