This application has been filed by the third defendant in the suit, seeking to condone the delay of 755 days, in filing the written statement.

2. In the affidavit filed, it had been stated that there are multiple cases filed within the family and as against each family member. Therefore, the delay had arisen in filing the written statement.

3. At any rate, taking a broader view of the entire issue that each party to the suit should be permitted to put forward his or her case, I would condone the delay and take the written statement on file. Order is passed after hearing the learned counsel for the plaintiff also.
