Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the respondents herein to issue sub-division patta transfer order to the petitioner for the land situate in Agrahara Manappalli village Mohanur Taluk Namakkal District comprised in S.No.42 admeasuring an extent of 4.36 Acres and for the land situate in Sarkar Manapalli village Mohanur Taluk Namakkal District comprised in S.No.41B/1D admeasuring an extent of 16.5 cents by considering the petitioner's representation dated 16.3.2024.

ORDER

With the consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.

This writ petition is filed to direct the respondents to consider the representation of the petitioner dated 16.3.2024 and issue sub-division patta transfer order to the petitioner for the land situate in Agrahara Manappalli Village, Mohanur Taluk Namakkal District comprised in S.No.42 admeasuring an extent of 4.36 Acres and for the land situate in Sarkar Manapalli village Mohanur Taluk Namakkal District comprised in S.No.41B/1D admeasuring an extent of 16.5 cents.

3. Heard learned counsel for the petitioner and the learned Government Advocate appearing for the respondents and perused the materials available on record.

4. The case of the petitioner is that the subject properties have been allotted to the petitioner by way of a partition deed entered among his family members. The grievance of the petitioner is that though he has applied for subdivision of his property and issuance of separate patta in the name of the petitioner, the same has not been considered by the respondents till date. Hence, the present Writ Petition.

5. Considering the limited prayer sought for in the Writ Petition, without going into the merits of this Writ Petition, the respondents are directed to consider the representation of the petitioner dated 16.03.2024 and pass Order on merits and in accordance with law within a period of two months from the date of receipt of a copy of the Order.
