We have gone through the evidence of PW1, PW3 and Doctor's evidence PW10. The deceased had given declaration before PW3, who is the relative of the deceased. The Doctor's evidence also speaks about the nature of injuries. The declaration of the deceased before PW3 also reveals about the occurrence.

Since the petitioner has not made out any prima facie case for grant of suspension of sentence, we are not inclined to grant the relief of suspension of sentence.

Consequently, the Criminal Miscellaneous Petition is dismissed. Post the Criminal Appeal after two weeks.
