CMP No.12612 of 2024 in CMA SR No.59386 of 2024 N.ANAND VENKATESH.,J The 3rd respondent remained ex-parte even before the Tribunal and hence, notice is dispensed with. Mr.R.Navaneethakrishnan, learned counsel has entered appearance for the 1st and 2nd respondents. 2.This Civil Miscellaneous petition has been filed seeking to condone the delay of 148 days in filing the Civil Miscellaneous Appeal.

3.Heard the learned counsel for the Appellant and perused the records.

4.Having satisfied with the reasons assigned in the affidavit filed in support of this petition, the miscellaneous petition is allowed and the delay of 148 days is condoned. 5.Registry is directed to number the main Civil miscellaneous appeal, if it is otherwise in order and list the same for admission and print the name of Mr.R.Navaneethakrishnan, learned counsel for the 1st and 2nd respondents at the time of admission.

6.It is made clear that for the period of delay of 148 days, the appellant will not be entitled for any interest if in the event of this Court enhancing the amount of compensation fixed by the Tribunal.
