The 1st respondent is the claimant and the 2nd respondent is the owner of the vehicle which is insured with the appellant Insurance Company. The Insurance Company does not dispute its liability. The 3rd respondent is the owner of the another vehicle which was involved in the accident and the 4th respondent is the insurer of the vehicle belonging to the 3rd respondent. The Tribunal has exonerated the 4th respondent from the liability.

2. Mr.S.Lakshmanasamy, learned counsel appears for the 1st respondent. Mr.B.Siva Kollapan, learned counsel appearing for the appellant would submit that he is only on quantum.

3. We therefore deem it unnecessary to hear other respondents. Accepting the reasons assigned in the affidavit filed in support of the petition, this petition is ordered and the delay of 173 days in filing the above appeal is condoned.
