O R D E R
The present criminal original petition has been filed seeking a direction to the first respondent to investigate the
complaint further or appoint an independent investigating officer to further investigate the complaint lodged by the petitioner dated 14.07.2015 pending on the file of the 5th respondent.
2. The petitioner herein lodged a complaint dated 14.07.2015 as against one Saravanan, Jayaraman, Santhanam, Ganapathi and M.Sureshkumar stating that this petitioner agreed to sell his property measuring to an extent of 2400 sq ft at Plot No.127, Survey No.317/1, Patta No.3949 to Jayaraman and entrusted the original documents to the above said person, but, the said Jayaraman, without paying the sale consideration, is trying to grab the property and refused to return the original documents with the criminal intimidation. Though C.S.R.No.316 of 2015 has been assigned to the said complaint, no action was taken by the respondents till date. Hence, the petitioner came forward to file this petition.
3. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor representing the respondents.
4. The learned Additional Public Prosecutor submitted that on receipt of the complaint, C.S.R.No. 316 of 2015 has been assigned and the matter is pending enquiry.
5. Considering the rival submissions, this Court directs the fifth respondent to conduct an enquiry on the complaint given by the petitioner dated 14.07.2015, if enquiry was not conducted so far and upon enquiry, if materials are gathered indicating commission of any cognizable offence, the fifth respondent is directed to proceed further in accordance with law, as early as possible.
6. The Criminal Original Petition is disposed of accordingly.
