ORDER

(This case has been heard through video conference) This Criminal Original Petition has been filed seeking for a direction, directing the 2nd respondent/police viz., The Inspector of Police, All Women Police Station, Sankari, Salem District to register the complaint dated 27.02.2021 given by the petitioner.

2.The petitioner had married the counter complainant viz. Santhoshkumar on 30.08.2018. After the marriage he had gone to Doha for his employment. The petitioner was living with her in laws after her marriage, during that time the petitioner was constantly harassed by her in laws and she was forcibly sent out

of the matrimonial house. Her husband had contact with several women, which was objected by the petitioner. He was moving very closely with his cousin sister Priya. The petitioner's husband though had come back to India, he had neither called upon the petitioner nor informed her about his return. Further, it is averred in the petition that the petitioner's husband got divorced and has got a seven year old daughter which fact was suppressed by him at the time of marriage. Stating these facts the petitioner had lodged a complaint on 27.02.2021 to the 2nd respondent police, thereby C.S.R.No.69 of 2021 assigned on 29.02.2021 and the petitioner was called for enquiry on 02.03.2021 thereafter the status of the case is not known to the petitioner. Hence the petition.

3.Mr.E.Raj Thilak, the learned Government Advocate (Crl. Side) would submit that on the complaint given by the petitioner, C.S.R.No.69 of 2021 assigned and both the parties were called for enquiry on 02.03.2021 and finding that it is a matrimonial dispute, they have agreed to dissolve the issue by filing a petition before the appropriate Court and further, the petitioner had already filed a petition in D.A.V.C.No.59 of 2021 before the Special Mahila Court, Magistrate level, Coimbatore and also M.C.No.45 of 2021 before the Principal Family Court, Coimbatore, the respondent police have closed the C.S.R.No.69 of 2021 on 02.03.2021.

4.At this juncture, the learned counsel for the petitioner would submit that the petitioner was not aware of the closure of the case.

5.In view of the above, the respondent police is hereby directed to serve the closure report to the petitioner. The petitioner may file objection, agitate the same. This Criminal Original Petition stands disposed of accordingly. Sd/- Assistant Registrar //True Copy// Sub Assistant Registrar kas
