The second defendant in O.S.No.1462 of 2011 is the revision petitioner herein.

2. Originally, the plaintiff/first respondent herein filed a suit in O.S.No.1462 of 2011, for the relief of declaration, setting aside the sale deed dated 25.07.2008 and also for permanent injunction.

3. The said suit was decreed by the trial Court on 27.07.2012. Aggrieved against the said ex parte decree, the second defendant has preferred this Civil Revision Petition.

4. The remedy available to the revision petitioner is to file an appeal and not a revision petition. Hence, this Civil Revision Petition is dismissed as not maintainable. No costs. Consequently, connected miscellaneous petition is closed.
