Respondents PRAYER: Writ petitions filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus to direct the 2nd respondents to strictly follow the Advertisement Policy and Guidelines issued by the Government of Puducherry, by way of gazette Publication in G.O.Ms.No.9 dated 9th July 2014 and to continue giving advertisements to the petitioner's monthly journal namely "PUTHIYA URAVU"periodically. O R D E R

Mr.J.Kumaran, learned Government Advocate (Puducherry) takes notice for the respondents. By consent of the parties, the main writ petition is taken up for final disposal at the admission stage itself.

2. Heard Mr.B.Barathkumar, the learned counsel appearing on behalf of the petitioner and the learned Government Advocate for the respondents.

3. The petitioner claiming to be the Editor of the monthly Tamil periodical journal, namely "PUTHIYA URAVU" is aggrieved against the action of the respondents in stopping the issuance of advertisements in the petitioner magazine without any reason.

4. It is contended by Mr.B.Barathkumar that though the respondents have chosen to give the advertisement to the petitioner's journal earlier, they have stopped issuing the same without giving opportunity of hearing to the petitioner. In support of the petitioner's claim, the learned counsel sought to rely on G.O.Ms.No.9 dated 09.07.2014.

5. It is seen that already, the petitioner has approached the 1st respondent and filed a representation on 23.06.2017 and that the said representation is still pending. Therefore, it is for the 1st respondent to consider the said representation of the petitioner and pass orders on the same on merits and in accordance with law after giving a reasonable opportunity of hearing to the petitioner also by considering the said G.O. dated 09.07.2014. Such exercise shall be done by the 1st respondent within a period of four weeks from the date of receipt of a copy of this order. Accordingly, the writ petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed.
