C.M.P.No.19957 of 2016 in C.R.P.(PD) No.216 of 2014 S.M.SUBRAMANIAM,J., The present Civil Miscellaneous Petition has been filed by the petitioner to direct the respondent to pay a sum of Rs.6,66,400/-, towards the arrears of rent in respect of the subject matter of the property situated in Plot No.4, 13th Floor, Second Wing, Door Nos. 2 & 6, Arihand Apartments, Jawaharlal Nehur Salai, Koyambedu, Chennai 600 107, for the duration from October, 2008 to November, 2016. 2.The learned counsel for the respondent admitted the fact that the rent has not been paid periodically, in view of the fact that the respondent has questioned the very ownership of the petitioner in respect of the property in which he is in occupation and hence, he was unable to pay the rent to the petitioner.
3.Such being the contention of the learned counsel for the respondent, the expectation is that the respondent ought to have deposited the rent to the credit of R.C.O.P.No.2283 of 2007, pending before the learned Rent Controller, XI Small Causes Court, Chennai. But, the respondent who is in occupation of the property as a tenant has not paid the rent from October 2008 till November, 2016, which is to be deprecated.
S.M.SUBRAMANIAM,J., rpa 4.Therefore, the respondent is directed to deposit the entire arrears of rent of Rs.6,66,400/-, to the credit of R.C.O.P.No.2283 of 2007, pending before the Rent Controller, XI Small Causes Court, Chennai, within a period of four weeks from the date of receipt of a copy of this order.
