Writ Petition filed under Article 226 of the Constitution of India seeking a writ of mandamus directing the first respondent to consider the petitioner's representation dated 24.07.2015 to demolish the unauthorised superstructure constructed by the second respondent and to demolish the wall which was illegally constructed in Survey No.172, Kasappur, Thiruvallur District.

The learned counsel for the petitioner seeks permission of this Court to withdraw the writ petition with liberty to file a suit before the Civil Court or to file a fresh writ petition by the concerned individual and has also made an endorsement to that effect as under:
"I may be permitted to withdraw and liberty may be given to me to file a suit before Civil Court or fresh W.P. by individual. Suitable order may be passed regarding the illegal construction of temple."
In view of the above submission and endorsement made by the learned counsel for the petitioner, this writ petition is dismissed as withdrawn, with liberty to file a suit, if so advised. No costs.
