O R D E R

This writ petition has been filed for issuance of a writ of certiorarified mandamus to quash the order passed by the Public Information Officer of the respondent University, Chennai in letter No.1212-50/ngh.j.m j.c.r / /2022, 1/4

dated 06.02.2023 and to consequently direct the respondent to order or permit migration to respondent University.

2. It is the case of the petitioner that she was selected for B.C.Sc & A.H. Programme under 15% VCI - All India Quota and allotted seat in the College of Veterinary Sciences & Animal Husbandry, Tripura for the academic year 2022-2023 and the result for the aforesaid course was published on 23.03.2023 by the Tripura University. Thereafter, she made an application seeking migration from the College of Veterinary Sciences & Animal Husbandry, R.K.Nagar, West Tripura under Tripura University before the respondent as per the guidelines of Veterinary Council of India. However, the Public Information Officer of the respondent has replied that no such provision is available in the University rules with regard to migration vide letter dated 06.02.2023. Challenging the same the present writ petition has been filed.

The learned counsel for the petitioner submits that though the petitioner has filed the above Writ Petition, challenging the impugned order dated 06.02.2023 passed by the Public Information Officer of the respondent, he fairly conceded that as against the said order, there is an effective appeal 2/4

remedy available before the appellate authority. Hence, he restricted his prayer and sought permission of this Court to file an appeal before the appellate authority.

4. On the above contentions heard learned counsel appearing for the respondent and perused the materials placed on record.

5. In view of the fair stand taken by the learned counsel for the petitioner, this Court, without interfering with the order under challenge, grants liberty to the petitioner to file appropriate appeal before the appellate authority concerned.
