Respondent Writ Petition is filed under Article 226 of the Constitution of India, praying for the issuance of a Writ of Mandamus, directing the respondent management to grant pay protection with continuity of service, back wages, wages and other attended benefits from 18.11.1994, the date on which the petitioner was relieved from service on medical ground, as per Section 47 of Persons with Disabilities (Equal opportunities, Protection of Rights and Full Participation) Act, 1995. ORDER

The relief sought for in this writ petition is for a direction to direct the respondent to grant pay protection with continuity of service, back wages, wages and other benefits with effect from 18.11.1994, under Section 47 of the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995.

2. The learned counsel, appearing on behalf of the writ petitioner, states that on account of certain disability, the writ petitioner was allotted with light work and however, the pay protection as provided under the said Act, has not been given to the writ petitioner.

3. The prayer sought for in this writ petition is large in nature, the learned counsel, appearing on behalf of the writ petitioner, restricted his prayer that it is suffice if a https://hcservices.ecourts.gov.in/hcservices/

direction is issued to the respondent to consider the representation submitted by the writ petitioner.

4. Without going into the merits of the matter, the respondent is directed to consider the representations submitted by the writ petitioner on 16.8.2011 and on 6.7.2014 and pass orders on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order. The writ petitioner is directed to enclose the copy of the representations along with the order passed in this writ petition.

5. Accordingly, the writ petition stands disposed of. However, there shall be no order as to costs.
