ORDER

The petitioner apprehends arrest for the alleged offence under Sections 191(2), 191(3), 296(b), 351(3) of BNS and Section 3(1) of TNPPDL Act, in Crime No.204 of 2025 on the file of the respondent police seeks anticipatory bail.

2. The allegation against the petitioner is that due to previous enmity, the petitioner along with other accused, trespassed into the house of the defacto complainant, abused him and his family members, assaulted them and also damaged the property of the defacto complainant. Hence, the case.

3. Learned counsel for the petitioner submitted that the petitioner is an innocent person and has been falsely implicated in this case by the respondent police and prayed for grant of anticipatory bail to the petitioner.

4. Learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution's case and, on instructions, submitted that there 12 previous cases, out of which two are under the NDPS Act, one under 302 IPC , one under 307 IPC and others under the Arms Act. Hence, he opposed the grant of anticipatory bail to the petitioner.

5. In such view of the matter, the petitioner has five previous cases against him, which clearly demonstrates that the petitioner has misused the liberty granted by this Court. Therefore, this Court is not inclined to enlarge the petitioner on anticipatory bail.
