C.M.P.No.13805 of 2023 in C.M.A.SR.No.18585 of 2018 SUNDER MOHAN,J.

This Petition has been filed seeking to condone the delay of 1469 days to restore the above CMP.No.13648 of 2018 in CMA.SR.No.18585 of 2018 dated 21.03.2019 on the file of this Court.

2. Though notice was served on the first respondent and name has also been printed in the cause list, none appeared on behalf of her.

3. Heard the learned counsel for the petitioners and the learned counsel for the second respondent.

4. Considering the averments made in the affidavit filed in support of this petition and being satisfied with the same, the delay is condoned on condition that the petitioners/appellants shall forfeit the interest for the delay period in the event of this Court enhancing the compensation. The appellant shall also pay cost of Rs.1,000/- to the Tamil Nadu State Legal Services Authority, High Court Campus, Chennai within a period of two weeks.

5. Registry is directed to number the C.M.A., if it is otherwise in order and list the same in due course.
