These civil miscellaneous petitions have been filed (a) to condone the delay of 1774 days in filing an application to set aside the abatement caused due to the death of the first respondent, (b) to set aside the abatement caused due to the death of the first respondent and (c) to bring on record the legal representatives of the deceased first respondent in the main second appeal.

2. Mr.I.Abrar Md.Abdullah, accepts notice on behalf of the proposed respondents and he has no objection for allowing these civil miscellaneous petitions.

3. This Court is also satisfied with the reasons stated in the affidavit filed in support of these petitions.

4. Accordingly, these civil miscellaneous petitions are allowed as prayed for.

5. Registry is directed to carry out the necessary amendments in the cause title and list the main second appeal for hearing on 08.09.2021. 11.08.2021 nl ABDUL QUDDHOSE, J.
