C.M.P.No.11152 of 2022 has been filed to amend the plaint in O.S.No.102 of 2017 on the file of the Court of II Additional District Judge, Puducherry for inclusion of an alternative relief of refund of advance amount with interest and another C.M.P.No.11154 of 2022 is for temporary injunction restraining the respondent men and agents from alienating or encumbering the suit B schedule property forming subject matter of O.S.No.102 of 2017

2. Since the suit has already been dismissed on the ground that he is not ready and willing to perform his contract, any alienation made pending appeal, will be subject to the result of the C.M.P.

3. Plaint may be amended in view of the settled proposition, with regard to C.M.P.No.11152 of 2022 to amend the plaint, in respect of additional relief of refund of court fee is allowed. The relief sought under C.M.P.No.11154 of 2022 is allowed.

5. The Registry is directed to amend the plaint and to be filed after notice to the appellant.

6. Post the matter after three weeks.
