ORDER

The petitioner, who was arrested and remanded to judicial custody on 02.12.2024 for the alleged offence under Sections 8(c) r/w 20(b)(ii)(c) of NDPS Act 1985 in Crime No.1501 of 2024 on the file of the respondent police, seeks bail.

2.The case of the prosecution is that the petitioner along with other accused were found in possession of 21 kgs of Ganja which is meant for sale. 3.The learned counsel for the petitioner would submit that the allegations against him are false; that the co-accused have been granted bail by this Court in Crl OP No.1296 of 2025 dated 30.01.2025 and in Crl.OP No.1857 of 2025 dated 06.02.2025. He would further submit that the petitioner is in custody from 02.12.2024. He would also submit that the petitioner is prepared to comply with any stringent condition that may be imposed by this Court and he prays for grant of bail to the petitioner.

The learned Government Advocate (Crl.side) for the respondent police submitted that on 02.12.2024, the petitioner is found with illegal possession of 21 kgs Ganga which is commercial quantity and the investigation is at crucial stage. He submitted that the petitioner is having ten numbers of previous cases under IPC including three murder cases and one NDPS Act, if the petitioner is granted bail, he will tamper the witnesses and hamper the investigation. Hence, he vehemently opposed for grant of bail to the petitioner. 5.Considering the facts and circumstances of the case, gravity of offence and the contraband seized from the petitioner comes under commercial quantity, this Court is not inclined to grant bail to the petitioner. Hence, this Criminal Original Petition stands dismissed.
