ORDER
Aggrieved by the order passed by the trial Judge in I.A. No. 4 of 2025 in OS.No.3170 of 2021 before the IV Additional District City Civil Court, Chennai, defendants 1 and 2 have preferred this revision.
2. Before the trial Court, the petitioners had filed applications to reopen the case, which were allowed in I.A. Nos. 2 and 3 of 2024. Thereafter, they filed an application in I.A. No. 4 of 2025 seeking to receive additional documents. However, the learned trial Judge dismissed the said application on the ground that it was filed only with an intention to delay the proceedings and that the petitioners ought to have filed the documents at the time of seeking reopening.
3. It is seen that the trial has already commenced, the plaintiff's evidence has been completed, and the matter is now posted for the defendants' evidence. At this stage, the defendants sought to mark documents on their side, but the Court below failed to grant such opportunity.
4. It is pertinent to note that the defendants' evidence has not yet commenced. At this stage, the defendants are entitled to produce all necessary
documents to substantiate their defence. Denial of such opportunity would seriously prejudice their right to defend the case.
5. Therefore, the reasons assigned by the learned trial Judge are erroneous and liable to be set aside.
6. Accordingly, the order passed in I.A. No. 4 of 2025 in O.S.No.3170 of 2021, on the file of the IV Additional District City Civil Court, Chennai, is set aside. The said application is allowed. The defendants are directed to cooperate for the expeditious disposal of the case.
7. This Civil Revision Petition is allowed. Consequently, the connected miscellaneous petition is closed. No costs.
