Respondent(s) PRAYER Writ petition filed under Article 226 of Constitution of India for the issue of writ of Certiorarified Mandamus to call for records of the impugned refusal endorsement made by the 3rd respondent dated 22.1.2024 in sale deed dated 22.1.2024 bearing pending Doc.No.P.No.12 of 2024 and quash the same as illegal and consequently direct the 3rd respondent to register the same with regular number.

ORDER
This writ petition has been filed challenging the impugned refusal endorsement made by the 3 rd respondent on 22.01.2024 wherein the 3 rd respondent has refused to register the sale deed dated 20.01.2024 on the ground that the petitioner must get a No objection certificate from the Air Force Authority.

Heard Mr.T.M.Mano, learned counsel for the petitioner and Mr.K.Karthick Jagannath, learned Government Advocate for respondents 1 to 4. 3.
In the considered view of this Court, the 4 th respondent has already
submitted a communication dated 08.01.2025 to the 3 rd respondent to the effect that the subject property does not come with the ambit of the Air force. Inspite of the same, the 3 rd respondent is insisting for a No objection certificate. That apart, it is also seen from records that the properties which are adjacent to the subject property, has been registered as document Nos.1414 of 2018 and 79 of 2025.

In view of the above, the 3 rd respondent is directed to once again verify from the 4 th respondent and if the subject property does not fall within the authority of the Air force, there shall be a direction to the 3 rd respondent to register the sale deed, if it is otherwise in order. 5.
