This application is filed to condone the delay in filing the written statement being the commercial dispute.

2. The 2nd defendant is supposed to file the written statement within 30 days from the date of receipt of suit summons, but he was not able to file the written statement within the time limit.

Therefore, there is 85 days delay in filing the written statement.

3. Since the statute permits condonation of delay upto 90 days, this application filed to condone the delay is allowed for the following reasons:

(i) Suit summons served on 10.10.2020. 30 days time limit for written statement is 09.11.2020.

(ii) the cause for delay due to pandemic situation and health condition of the 2nd defendant.

4. Post the matter for admission and denial on 25.08.2021.
