Writ petition is filed under Article 226 of the Constitution of India praying to issue Writ of Mandamus, directing the first respondent to dispose of 1/6

the application filed by the petitioner through Petitioner Banker, The Branch Manager, Centralised Pension Processing Centre - Chennai, Indian Bank, T.Nagar, Chennai - 600 017 for SSSY family pension, vide their letter in Ref.No.SSSY:24/ 2023 dated 26.12.2023 and grant the eligible pension in an expeditious manner and pass orders.

ORDER

Mr.R. Rajesh Vivekanandan, Deputy Solicitor General of India takes notice for the first respondent. Since no adverse orders has been passed against the second and third respondents, notice is dispensed with.

2. By consent of both the parties, this writ petition is taken up for final disposal at the stage of admission itself.

3. This writ petition is filed seeking for a Writ of Mandamus directing the first respondent to dispose of the petitioner's application for grant of SSSP pension and grant the eligible pension in an expeditious manner and pass orders.

4. The petitioner's father was a freedom fighter and was granted pension by the Government of India under SSSP rules from 24.09.1991. The petitioner's father died on 16.04.2021, at the age of 96, leaving behind the petitioner's mother, two sons and two daughters as his legal heirs. After the demise of petitioner's father the petitioner's mother was sanctioned pension under the dependent category. Thereafter, the petitioner's mother died on 12.10.2023. As the petitioner is a widowed daughter of the pensioner she approached the Respondent/Bank for transfer of dependent pension to her. The Respondent/Bank forwarded the request of the petitioner to The Under Secretary to Government of India, on 26.12.2013. As there was no reply/response the petitioner submitted two letters on 20.04.2024 and 3/6

10.12.2024 to the concerned Department. But, there was no response even to the said letters. Therefore, the petitioner left with no other alternative approached this Court for the above said relief.

5. Heard both sides and perused the materials available on record.

6. The facts of the case are not disputed. Hence, considering the limited prayer sought for by the petitioner, this Court without going into the merits of the case, directs the first respondent to consider and pass orders on the petitioner's representation dated 26.12.2023, on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order. It is made clear that the first respondent shall give a reasonable opportunity to the petitioner for filing the written submissions in support of her application.

7. Accordingly, this writ petition is disposed of. However, there shall be no order as to costs.
