ORDER : The Court Made the following order :- The petitioner who was arrested on 04.08.2020 and remanded to judicial custody for the alleged offence under Sections 394, 459, 397, 342, 114 of IPC in Cr.No.1999 of 2020 on the file of the respondent police, seeks bail.
2.The case of the prosecution is that the petitioner along with the other accused persons have committed theft of 821 bottles of brandy in Tasmac shop. Based on the complaint, the respondent police have registered a case against the petitioner. 3.The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case and prays for bail.
4.The learned Government Advocate submitted that the petitioner is a habitual offender and further submitted that there are eleven previous cases pending against the petitioner. He further submits that this is the second bail application and the earlier bail application was dismissed by this Court on 07.07.2021 in Crl.O.P.No.11554 of 2021. Hence, he vehemently oppose to grant bail to the petitioner.

5.Considering the fact that the petitioner is a habitual offender and there are eleven previous cases pending against the petitioner and there is no change in circumstances , this Court is not inclined to grant anticipatory bail to the petitioner. 6.Accordingly, this criminal original petition is dismissed. -sd/- 26/07/2021 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
