(CRIME NO.5 OF 2018) Petitions praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to [i] modify the condition (b) imposed on the petitioner vide order dated 25.06.2020 made in the above Crl.O.No.9172 of 2020 to an extent of permitting the petitioner to offer sureties from two Government Servants for his release instead of "the petitioner shall deposit the original title deed stands in his name, not less than the value of Rs.50,000/- (Rupees Fifty Lakhs only) along with proper valuation certificate obtained from the concerned authority. [IN CRL.MP.NO.5464/2020 IN CRL.OP.NO.9172/2020] [ii] relax the conditions of anticipatory bail imposed on the petitioner on 25.06.2020 and made in Crl.OP.No.
9172 of 2020 and direct the petitioner to appear before the Inspector of Police, Mettur, instead of Inspector of Police, District Crime Branch, Salem. [IN CRL.MP.NO.5465/2020 IN CRL.OP.NO.9172/2020] Order : These petitions coming on for orders upon perusing the petitions and the filed in support thereof and upon hearing the arguments of M/S. V.BHIMAN, Advocate for the petitioner [in both the petitions] and of M/S.
These petitions have been filed seeking to modify the condition (b) and to relax the condition (c) imposed on the petitioner by this Court by order dated 25.06.2020 in Crl. O.P. No.9172 of 2020.
2. Learned counsel for the petitioner would submit that the petitioner has nothing to do with the crime committed by other accused. He would further submit the petitioner is working as Foreman in the Mettur Thermal Power Station, Salem District and that he does not possess any property in his name to the value of Rs.50,00,000/-. He would further submit that he is ready to deposit the title deeds stands in his friends name or in his relatives name. Therefore, he seeks modification of the condition (b). In so far as Crl.M.P. No.5465 is concerned, he would submit that since the petitioner is working at Thermal Power Station he could not able to report before the respondent at Salem. Therefore, he seeks relaxation of condition (c).
3. Learned Additional Public Prosecutor would submit that there are totally seven accused and the petitioner is arrayed as A6 and he had collected money from three victims to the tune of Rs.32,00,000/-.
4. Taking into consideration the facts and circumstances of this case, the condition (b) imposed by this Court in order dated 25.06.2020 in Crl.O.P. No.9172 of 2020 is modified to the effect that the petitioner shall deposit the original title deed stands in his name or his friends name or in his relatives name, not less than the value of Rs.50,00,000/- (Rupees Fifty Lakhs Only) along with the property valuation certificate issued by the concerned authority, before the Court below. The other conditions imposed by this Court in Crl.O.P.
