Petition filed under Article 226 of the Constitution of India for the issuance of writ of Mandamus, directing the second respondent to permit the petitioner to join duty in the TASMAC Shop No.9013 (Srikalikapuram), Thiruvallur District.

O R D E R

The petitioner was working in TASMAC Shop No.9013 as Salesman. While so, he applied for medical leave on 03.12.2013. According to him, after recovery from illness, he requested the second respondent to permit him to join duty. But the second respondent did not allow him to join duty. Hence, he made a representation dated 21.11.2014 requesting the second respondent to permit him to join duty. According to the petitioner, the said representation was given in person. The petitioner has now come up with this writ petition, seeking for a direction to the second respondent to permit him to join duty.

2. When the writ petition was taken for hearing, the learned counsel for the petitioner submitted that the writ petition could be disposed of, permitting the petitioner to submit a fresh representation to the second respondent.

3. In the light of the submission made by the learned counsel for the petitioner, the writ petition is disposed of, permitting the https://hcservices.ecourts.gov.in/hcservices/

petitioner to submit a representation to the second respondent. In case any such representation is made, the second respondent is directed to consider and pass orders on merits and as per law and taking into account the fact that the petitioner was in employment for about 10 years and did not attend duty for some time due to illness, within a period of eight weeks from the date of receipt of a copy of this order. No costs.
