ORDER

The present criminal original petition has been filed seeking a direction to the respondent to register the petitioner's complaint dated 30.10.2015 in accordance with law.

2. In the petition, it is averred that one Jagannathan is known to the petitioner. The said Jagannathan informed the petitioner that his elder brother was working in the Railway

Department and his brother is having influence and power in the Railway Department and he would arrange Central Government job to the petitioner in the Railway Department on payment of Rs.2,50,000/-. Believing his words, the petitioner has given a sum of Rs.2,50,000/- to the said Jagannathan by way of cash. After receiving the amount, he misappropriated the said amount and he cheated the petitioner. Hence, the petitioner lodged a complaint with the respondent police on 30.10.2015. But, till date, no action has been taken on the said complaint. Hence, the petition.

3. Learned Additional Public Prosecutor submitted that the said complaint was sent only by post. If the petitioner gives a fresh complaint in person, the respondent would take appropriate action.

4. Considering the submissions made on either side, this Court is constrained to pass the following order:- (i) The petitioner is directed to give a fresh complaint to the second respondent within a period of one week from the date of receipt of a copy of this order, along with a copy of this order.

(ii) On receipt of the same, the second respondent is directed to conduct enquiry on the said complaint, and upon enquiry, if materials are gathered indicating commission of any cognizable offence, then the second respondent is directed to proceed further in accordance with law, as early as possible.

5. The criminal original petition is disposed of accordingly.
