O R D E R

The Writ Petition is filed for issuance of a Writ of Mandamus directing the 1st respondent to dispose of the petitioner's application dated 21.01.2025, filed under Section 23(1) & (2) read with Section 24 of the Maintenance and Welfare of Parents and Senior Citizen Act, 2007, within a time frame stipulated by this Court.

2. The petitioner is the second wife of one P.Gopalakrishnan. The petitioner's husband is blessed with a son, the 2nd respondent herein and a daughter born through his first wife, Vijayalakshmi, who predeceased him. The petitioner states that her husband purchased a plot in Thiruvottriyur Village, Chennai and constructed a house in the year 1994. The petitioner's husband is suffering from Atypical Parkinsonism for the past four years. The 2nd respondent though residing in Saudi Arabia, came down to Chennai, in November, 2022, and obtained a settlement deed on 22.11.2022, from the petitioner's husband promising to take care of his needs. As the 2nd respondent obtained the settlement deed fraudulently and neglected to take care of his father, the petitioner filed an application on 21.01.2025, to the 1st respondent invoking Sections 23(1) and (2) read with Section 24 of the Maintenance and Welfare of Parents 2/4

and Senior Citizen Act, 2007. In the said application, the 1st respondent summoned the petitioner for enquiry on 30.01.2025. The petitioner appeared on 17.03.2025 and gave her statement. Thereafter, the 1st respondent did not take any further steps and therefore, the petitioner was constrained to file the Writ Petition for the above said relief.

3. The learned Government Advocate appearing for the 1st respondent submits that reasonable time may be granted to the 1st respondent to dispose of the petitioner's application.

4. In view of the fact that the application of the petitioner is kept pending for more than four months, without any final decision on the same, I am inclined to direct the 1st respondent to dispose of the petitioner's application dated 21.01.2025, on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order. The Writ Petition is accordingly disposed of. There shall be no order as to costs.
