PRAYER: Petition filed under Article 226 of the Constitution of India, praying to direct the respondent not to harass the petitioner in the guise of enquiry.

ORDER

This writ petition has been filed directing the respondent not to harass the petitioner under the guise of enquiry.

2. The learned counsel for the petitioner would submit that the defacto complainant borrowed a sum of Rs.18 lakhs from the petitioner. Since he was not able to repay the same, the mother of the defacto complainant, namely Padmavathi sold her land bearing plot No.9 comprised in S.No.313 and 314 in Mudichoor Village, Tambaram Taluk, to an extent of 2280 sq.ft. After deducting the loan amount, a sum of Rs.2 lakhs has been paid to the said Padmavathi. and executed sale deed in favour of the petitioner on 07.08.2020. Now, the petitioner has put up superstructure and has also made improvements worth about Rs.15 lakhs and rented out the premises. Now, all of a sudden, the petitioner has given a false complaint against the petitioner as if the sale deed has been obtained by the petitioner under coercion. Eventhough, the enquiry has been conducted and closed, the respondent police is harassing the petitioner continuously. 3. The learned Government Advocate (crl. side) appearing for the respondent would submit that based on the complaint given by one Immanuel Ravikumar, CSR No.448 of 2021 has been assigned, in which, enquiry has been conducted and closed on 19.07.2021.

3. Recording the said submission, this writ petition is dismissed. No costs.
