Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the respondents to consider the representation dated 16.02.2021 and 14.07.2021 to demarcate and issue separate Patta to the petitioner in respect of the the land to an extent of 0.65 cents situated in S.No.167/1, in Thirumani Village, Thirukazhukundram Taluk, within a stipulated time.

ORDER

This writ petition has been filed seeking a direction to the respondents to demarcate and issue separate patta to the petitioner.

2. According to the petitioner, her husband executed a settlement deed in favour of the petitioner in respect of the property in S.No.167/1, Thirumani Village, Thirukazukunram Taluk . After the demise of her husband, she filed an application https://hcservices.ecourts.gov.in/hcservices/

dated 16.02.2021 before the 3rd respondent seeking for transfer of patta in her name and also to demarcate the property. But, no order has been passed, so far. Hence, the present writ petition has been filed.

3. Heard the learned counsel for the petitioner and the learned Government Advocate appearing for the respondents.

4. Considering the facts and circumstances of the case and considering limited prayer sought for in the writ petition, and the petitioner's application dated 16.02.2021 is pending with the 3rd respondent/Tahsildar, the 3rd respondent is directed to consider the petitioner's application and pass suitable orders, on merits and in accordance with law, after giving opportunity to the petitioner as well as the other interested persons, if any, within a period of twelve (12) weeks from the date of receipt of a copy of this order.

5. With the above directions, this Writ Petition is disposed of. No costs.
