(Order of the Court was made by J.NISHA BANU,J.) This writ petition has been filed to direct the respondents 1 to 4 to consider the representation dated 15.03.2025 and 26.03.2025 made by the petitioner and take action against the illegal, unauthorised and unlawful 2/6
construction put up by the 5th respondent over the land in S.No.38/3B3, Mettupalayam Village, Thiruthuriapoondi Taluk, Tiruvarur District, comprised in Door No.1/118, Amman Nagar Main Road, Mettupalayam Village, within a time frame as may be fixed by this Court.
2. The case of the petitioner is that the 5th respondent without any permission either from the authorities or from any of the legal heirs, had demolished the ancestral house and putting illegal and unauthorised construction . Therefore, a complaint was lodged on 15.04.2024 to the local police, but no action was taken. A representation was also given to the 3rd and 4th respondents on 15.03.2025, but no action was taken. The petitioner has sent another representation on 26.03.2025 to respondents 1 to 4 seeking to stop the illegal and unauthorized construction put up by the 5th respondent. Since no action was taken, the present writ petition has been filed.
3. Heard the learned counsel for the petitioner an the learned Special Government Pleader appearing for the 1st and 2nd respondents.
4. Considering the facts and circumstances of the case, we direct the 3rd and 4th respondents to consider of the representations of the petitioner 3/6
dated 15.03.2025 and 26.03.2025, by giving opportunity of personal hearing to the petitioner as well as the 5th respondent and thereafter, take action in the manner known to law, within a period of twelve weeks from the date of receipt of a copy of this order. Accordingly, the Writ Petition is disposed of. No costs.
