No.178/2014 dated 30.11.2016, confirmed by the Learned III Additional Sessions Judge, Vellore @ Thiruppathur, Vellore, Vellore District in CRL.A.NO.1/2017 dated 19/03/2019 pending disposal of the CRL RC.415/2019 Order : This petition coming on for orders upon perusing the petition and the Memorandum of Grounds in CRL RC.415/2019 on the file of the High Court and upon hearing the arguments of M/S.E.KANNADASAN, Advocate for the petitioner and of M/S.M.

PRABHAVATHI, ADDITIONAL PUBLIC PROSECUTOR on behalf of the Respondent the court made the following order:- This criminal miscellaneous petition has been filed to exempt the petitioner from surrendering the judgment passed by the learned Judicial Magistrate No.I, Thiruppathur, Vellore District in C.C.No.178 of 2014, dated 30.11.2016, confirmed by the learned III Additional Sessions Judge, Vellore at Thiruppathur, Vellore District in Crl.A.No.1 of 2017 dated 19.03.2019, pending disposal of the above criminal revision.

2.This petition is closed, since suspension of sentence can be granted even if the accused has not surrendered and is not undergoing confinement as per the Judgement of this Court reported in 2008 1 MLJ Crl 1001 [R.Ramamoorthy Vs. The Inspector of Police, Crime Branch, Erode].
