C.E.PRATAP, Govt. Advocate ( Crl. Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- (The case has been heard through video conference) The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence under Section 399 of IPC in Crime No.102 of 2021, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner along with other accused were in possession of deadly weapons and planned to commit dacoity and caught red-handed by the respondent police. Hence, the complaint.

3.The learned counsel appearing for the petitioner submits that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) submits that the petitioner along with other accused were in possession of deadly weapons and planned to commit dacoity. He further submits https://hcservices.ecourts.gov.in/hcservices/

that the petitioner has two previous cases to his credit and this is the petitioner's second bail application and the previous application was dismissed by this Court on 01.07.2021 in Crl.OP.No.11288 of 2021. Hence, he vehemently opposed to grant bail to the petitioner.

5. Taking into consideration of the previous cases facts and circumstances of the case and there is no change in circumstances, this Court is not inclined to grant bail to the petitioner.
