ORDER

The petitioner, who was arrested and remanded to judicial custody on 14.03.2026 for the alleged offences under Sections 63, 64, 75, 76 and 351(2) of the Bharatiya Nyaya Sanhita, 2023, in Crime No.05 of 2026 on the file of the respondent police, seeks bail.

2.The case of the prosecution is that the petitioner being a Manager, had allegedly blackmailed the defacto complainant and had sexual intercourse with her on several occasions and thereafter she found that she was pregnant. Hence, the case was registered.

3. The learned counsel appearing for the petitioner submitted that the petitioner has been in incarceration since 14.03.2026 and according to the prosecution, the relationship was consensual in nature and therefore he has been falsely implicated in this case. The learned counsel for the petitioner further submitted that the petitioner is ready to abide by any condition that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent submitted that the statement under Section 183 of BNSS has been recorded and the investigation is still pending and DNA result is awaited. Hence, he opposed to grant bail to the petitioner.

5. I have given anxious consideration to the submissions made by the learned counsel on either side.

6. Considering the submission of the learned counsel on either side and considering the nature of allegation and the fact that the investigation is still

pending and DNA result is awaited, this Court is of the view that this is not an appropriate stage to consider the bail application of the petitioner. Hence, this Court is not inclined to grant bail to the petitioner.
