2. The brief facts which has culminated in the filing of these writ petitions are set out below:

2.1. It is the case of the petitioners that they were appointed as Driver and Conductor and retired from service. The respondent settled their terminal benefits with a delay. Therefore, the respondent is legally bound to pay interest to the petitioners. Therefore, the petitioners made a representation to the respondent to pay the interest at the rate of 6% p.a., for the belated payment of

the petitioner's terminal benefits. Since there is no response, the petitioner is before this Court.

3. Heard the learned Counsel on either side and perused the materials available on records.

4. Admittedly, the Gratuity, Provident fund, EL Surrender and Leave Salary has been paid belatedly for no fault of the petitioners. Therefore, the petitioners are entitled to interest on the same. Therefore, the Writ petitions are allowed as prayed for and a mandamus is issued directing the respondent to disburse the 6% interest for belated payment of Gratuity, Provident fund EL Surrender and Leave Salary from the date of Retirement to the date of actual payment within a period of one (1) month from the date of receipt of a copy of this order. No costs.
