Respondents / Defendants PRAYER: Appeal is filed under Section 100 of the Civil Procedure Code against the Judgment and Decree, dated 18.08.2010, rendered in A.S.No.42 of 2008, on the file of the Principal District Judge, Chengalpattu, confirming the Judgment and Decree, dated 09.02.2007, rendered in O.S.No.55 of 2004, on the file of the Principal Subordinate Judge, Chengalpattu.

JUDGMENT

The appellant has filed the above C.M.P.No.3134 of 2016 stating that out of court settlement has been effected and accordingly, the parties have entered into a terms of compromise which is typed in the non judicial stamp paper filed along with the said miscellaneous petition.

2. When the matter was called, both the appellant and respondents 1 and 2 are present and they have expressed that they have consented for recording the memo of compromise. Under the memo of compromise the 3rd and 4th respondents, who are tenants, have already vacated and handed over the possession to the respondents 1 and 2. As both the appellant and respondents 1 and 2 have no objection for recording the memo of compromise, https://hcservices.ecourts.gov.in/hcservices/

C.M.P.No.3134 of 2016 is allowed.

3. In view of the memo of compromise entered in C.M.P.No.3134 of 2016, the Second Appeal stands disposed of on the terms of the compromise entered into between the parties in the said C.M.P.No.3134 of 2016. The terms of the compromise shall form part of the decree. No costs.
