G.Murugan, v. The Government Of Tamil Nadu,

2023-03-20Honourable Mr Justice M.Dhandapani3 pages

M.DHANDAPANI, J.

This petition has been filed to modify the order in W.P. No.1228 of 2013, dated 21.04.2022.

2. Today, when the matter is taken up for hearing, the learned counsel for the petitioner submitted that the dispute involved in this writ petition is with regard to acquisition of lands for industrial purposes. He further submits that the representing counsel by a bare reading of counter affidavit has failed to put forth his arguments before this Court on 21.04.2022 and due to which, the respondents have exempted 0.12.0 Ares out of total extent of 0.029.0 Ares. Hence, he sought for modification of the aforesaid order.

3. On perusal, it reveals that the claim of the petitioner cannot be entertained, as separate cause of action will arise and the same cannot be considered in this petition and the petitioner has to agitate the issue by filing a separate writ petition.

4. In view of the above, modification sought for in this W.M.P. Cannot be granted and therefore, this petition is dismissed. However, liberty is granted to the petitioner to work out his remedy in the manner known under law.
