Respondent(s) PRAYER:This Writ Petition is filed under Article 226 of Constitution of India seeking Writ of Certiorarified Mandamus to call for the records on the file of the respondents relating to the impugned order in RC No.17409 / Pen(5) / 2015, dated 07.02.2018 passed by the first respondent and quash the same in so far as deducting and adjusting the gratuity amount of Rs.2,85,056 in favour of the third respondent society and direct the respondents to settle the retirement benefits due to the petitioner with interest at the rate of 12% per annum to the petitioner with cost.

ORDER

This Writ Petition is filed seeking to quash the impugned order in RC No.17409 / Pen(5) / 2015, dated 07.02.2018 passed by the first respondent, in so far as deducting and adjusting the gratuity amount of Rs.2,85,056 in favour of the third respondent society and to direct the respondents to settle the retirement benefits due to the petitioner with interest at the rate of 12% per annum to the petitioner with cost.

2. The learned counsel for the respondents would submit that the petitioner died on 29.02.2019.

3. In view of the above, this Writ Petition is dismissed as abated. No costs.
