O R D E R

The present criminal original petition has been filed to direct the second respondent to register FIR based on the complaint dated 07.10.2015 in C.S.R.No.482 of 2015 on the file of the second respondent and investigate the same and file the final report within stipulated period.

2. The case of the petitioner is that the petitioner herein has lodged a complaint as against one Ranganayaki stating that on 05.10.2013 the petitioner and her husband borrowed a sum of Rs.3,00,000/- from the said Ranganayaki and the petitioner has repaid the amount along with interest to the tune of Rs.15,00,000/-. But the said Ranganayaki is demanding further amount of Rs.13,00,000/- from the petitioner, interest at the rate of 10% for Rs.100/-. While so, on 05.10.2015 at 6.00 p.m. the said Ranganayaki, her husband and her son Vidhyasagar along https://hcservices.ecourts.gov.in/hcservices/

with two identified persons have trespassed in to the residence of the petitioner and threatened the petitioner and her family members with dire consequences. Immediately the petitioner has lodged a complaint as against the said persons. Though C.S.R.No.482 of 2015 has been assigned, no action was taken till date. Hence, the present criminal original petition has been filed.

3. I have heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondent.

4. In view of the submissions made on either side, this Court directs the second respondent to conduct enquiry and upon enquiry, if materials are gathered indicating commission of any cognizable offence, he is directed to proceed further in accordance with law, as early as possible.

5. This criminal original petition is disposed of accordingly.
