ORDER : The Court Made the following order :- The petitioners, who apprehend arrest at the hands of the respondents police for alleged offences punishable under Sections 406 and 420 of IPC, in Crime No.100 of 2022 on the file of the third respondent police, seeks anticipatory bail.
2. The case of the prosecution is that the petitioner A1 is the General Manager of the company M/s.Seaways Shipping and Logistics Limited and he joined hands with the company "M/s.Apogee Reach Solutions and Services and misappropriated an amount of Rs.35 lakhs and the same was sanctioned by A1 and the entire allegation was made
only against the first accused. Further it is alleged that the first petitioner resigned his job on 09.12.2021 and since his last working, he was continued to engage in fraudulent activities. Hence, the complaint.
3. The learned counsel for the petitioners would submit that false complaint has been given against the petitioners and they have nothing to do with the said allegations. He further submitted that Interstate Anticipatory bail may be granted to them to enable them to move the appropriate jurisdictional Court in the Hyderabad for necessary relief.
4. Taking into consideration the facts and circumstances of the case, this Court is inclined to grant inter-state interim anticipatory bail to the petitioners for a period of six weeks from today to enable them to move the concerned Court.
5. Accordingly, interim interstate anticipatory bail is granted to the petitioners for a period of six weeks, on condition that the petitioners shall surrender before the learned XXIII Metropolitan Magistrate, Saidapet, Chennai within a period of fifteen days from the date on which the order copy made ready and the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees ten thousand only) each, with two sureties each for a like sum to the satisfaction of the said learned Magistrate. Further, within four weeks from the date of execution of bail bond, the petitioners shall approach the competent Court in Hyderabad and seek appropriate relief. -sd/- 14/06/2022 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
