ORDER
The petitioner apprehends arrest for the alleged offence under Section 296 (b), 121 (1) and 351 (3) of BNS, 2023, in Crime No.66 of 2026 on the file of the respondent police seeks anticipatory bail.
2. The case of the prosecution is that the defacto-complainant is the Sub Inspector of Police and due to a wordy quarrel, the petitioner along with the other accused, abused and assaulted the defacto-complainant due to which the defacto-complainant sustained grievous injury all over his body. Hence, the case.

3. The learned counsel for the petitioner submitted that the petitioner is innocent and has been falsely implicated in this case. He further submitted that he is ready to abide by any conditions that may be imposed by this Court and that he is ready to cooperate with the investigation. Hence, he prayed to grant anticipatory bail to the petitioner.
4.The learned Government Advocate (Criminal Side) appearing for the respondent Police reiterated the prosecution case and also submitted that this is the second anticipatory bail petition filed by the petitioner and there is no change in circumstances.
5. Considering the fact that it is a case where the petitioner assaulted the defacto-complainant who is a public servant and also considering that there is no change in circumstances from the earlier petition, this Court is not inclined to grant anticipatory bail to the petitioner.
