O R D E R

The present criminal original petition has been filed seeking a direction to the respondent to register the petitioner's complaint dated 26.09.2015 and investigate the same in accordance with law.

2. In the petition, it has been stated that the petitioner's husband has lodged several complaints for removal of dust and solid wastages, which was accumulated by certain persons in the public place. While so, on 24.09.2015, the petitioner's husband and her son viz., Hari Baskar were abused and assaulted by the following persons viz., Perumal S/o.Periyakkannu Gounder, Ganesh S/o.Perumal Gounder, Govindhammal W/o.Kanniyappan, Balamani W/o.Ranganathan, Rathinampal W/o.Sundaramoorthy, Unnamalai W/o. Marimuthu and Periyakannu S/o.Saravanan Gounder and due to the assault, the petitioner's husband sustained grievous injuries https://hcservices.ecourts.gov.in/hcservices/

and he was admitted in the Government Hospital at Tindivanam. In this regard, the petitioner has given a complaint before the respondents police on 26.09.2015, but till date no action was taken. Hence, the petitioner has filed the present criminal original petition.

3. I have heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.

4. The learned Additional Public Prosecutor submitted that the complaint was sent only by post and if the petitioner gives a fresh complaint, necessary action will be taken.

5. In view of the submissions made on either side, this Court directs the petitioner to give a fresh complaint along with the copy of this order before the respondents police within a period of one week from the date of receipt of a copy of this order, and on receipt of the same, the respondents are directed to conduct enquiry and upon enquiry, if materials are gathered indicating commission of any cognizable offence, the respondents are directed to proceed further in accordance with law, as early as possible.

6. This criminal original petition is disposed of accordingly.
