3. Notice has been served on the fourth respondent and the name of the fourth respondent has also been printed in the cause list.

4. Heard the learned counsel on either side and perused the records.

5. Having satisfied with the reasons assigned in the affidavit filed in support of this petition, this miscellaneous petition is allowed and the delay of 54 days in filing the above appeal is condoned.

Registry is directed to number the main Civil Miscellaneous Appeal, if it is otherwise in order and list the same for admission in due course. Registry is directed to print the name of Mr.A.Sundaravadhanan, learned counsel for respondents 1 to 3 at the time of admission.
