O R D E R

The present criminal original petition has been filed seeking a direction to the 1st respondent to initiate and register a crime in the branch of the 2nd respondent i.e. The District Crime Branch, Thiruvarur and investigate the matter with immediate recovery of the vehicle and to file a final charge sheet as against the offenders involved in the crime.

2. The petitioner submits that he agreed to sold his car to one Prakash for a sum of Rs.1,10,000/- and the said Prakash has paid a sum of Rs.25,000/- as advance. Thereafter, he did not pay any amount. When the petitioner asked to pay the balance

amount, he was threatened by the said Prakash. Hence, the petitioner has lodged a complaint on 11.10.2015. But, till date no action was taken. Hence, the present criminal original petition has been filed.

3. I have heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.

4. The learned Additional Public Prosecutor submitted that on receipt of the complaint of the petitioner, C.S.R.No.513 of 2015 has been assigned and the matter is pending for enquiry.

5. In view of the submissions made by the petitioner as well as the Additional Public Prosecutor, this Court directs the 1st respondent to conduct enquiry on the complaint of the petitioner dated 11.10.2015 in C.S.R.No.513 of 2015 and upon enquiry, if materials are gathered indicating commission of any cognizable offence, the 1st respondent is directed to proceed further in accordance with law, as early as possible.

6. This criminal original petition is disposed of accordingly.
