PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Certiorarified Mandamus, calling for the records from the 1st and 3rd respondents, quash the order of the 1st respondent dated 14.05.2025 bearing G.O.Ms.No.115 Finance (OP-1 Department) and the order of the 3rd respondent dated 28.02.2025 bearing Memorandum No.1102/PSD-I2/2024 as illegal, arbitrary and contrary to law and in violation of principles of natural justice and consequently direct the respondents to continue to reinstate the petitioner in the post of Assistant in Finance Department with continuity of service, full back wages and all other attendant benefits.

O R D E R

This Writ Petition has filed challenging the order dated 14.05.2025 passed by the 1st respondent and consequential order dated 28.02.2025 passed by the 3rd respondent and for a direction to the respondents to continue to reinstate the petitioner in the post of Assistant in Finance Department with the continuity of service, full back wages and all other attendant benefits.

The learned counsel for the petitioner would submit that the petitioner is an ex-serviceman and applied for Group-II services in the 2nd respondent and he passed preliminary examination and also main examination. His certificates were verified thereafter, he was issued an provisional appointment order by the 3rd respondent and thereafter, the appointment by the 1st respondent on 11.11.2024. The applicant joined in the post of Assistant in the Finance Department and he had been working from 08.11.2024, while so, the 3rd respondent issued an order dated 28.02.2025 which was received by the petitioner on 04.04.2025 through post, cancelling the selection of the petitioner without assigning any reason

and without any notice and conducting any enquiry. Challenging the same, the present writ petition is filed.

3. The learned counsel for the petitioner after much deliberation would submit that the petitioner's Role Number is 0107009271. However, there are two papers written examination was conducted and there was no conclusion with regard to the first paper and there was a conclusion with regard to the second paper and the answer sheet was changed in between two candidates. The petitioner's answer sheet was inadvertently given to one Rangaramu, whose Registration Number is 0107008271 and thereby, the mark awarded to the said Rangaramu, having Registration No. 0107008271 was given to the petitioner and the marks for Registration No.0107009271 of the petitioner was given to Rangaramu and subsequently, petitioner was given appointment and after finding the said mistake, the order of termination was passed.

4. However, in view of the answer sheet produced by the respondent, learned counsel for the petitioner would fairly submit that this entire

conclusion was done only because of the inefficient Officials thereby, the petitioners rights cannot be deprived. Accordingly, he prayed for reasonable compensation to the petitioner.

5. Heard learned counsel petitioner as well as the learned Special Government Pleader appearing for the respondents.

In the present case, admittedly, the petitioner's answer sheet was inadvertently given to one Rangaramu, whose Registration Number is 0107008271 and thereby, the mark awarded to the said Rangaramu, having Registration No. 0107008271 was given to the petitioner and the marks for Registration No.0107009271 of the petitioner was given to Rangaramu and Subsequently, petitioner was given appointment and after finding the said mistake, the order of termination was passed. It is admitted that the whole confusion occurred because of the inefficient officials by wrongly providing marks scored by one person to another person. Once it is found that the post given to the petitioner was based on the marks scored by another person, the termination order passed by the respondent cannot be interfered with.

7. In the result, this Writ Petition is dismissed. No costs. Consequently, connected miscellaneous petitions are closed. 09.12.2025 NCC: Yes / No Index : Yes / No Speaking Order : Yes / No kkn
