A.Nos.2701 and 4322 of 2024 A.Nos.2701 and 4322 of 2024 in Arb.OP.(Comm.Div) No.148 of 2021 K.KUMARESH BABU.,J The present applications have been filed seeking to substitute the new Arbitrator in the place of the Hon'ble Mr.Justice P.Shanmugam due to his demise and also to extend the mandate to the new Arbitrator to be appointed for conclusion of Arbitral Proceedings.

2. When the matter was taken up by this Court, the respective counsels appeared on either side have admitted to the fact that the nominated Arbitrator is no more and therefore a new Arbitrator had to be substituted in the place for completion of Arbitration Proceedings.

3. In view of the consent that had been arrived at between the learned counsels, I am inclined to appoint Mr.Justice S.Vaidyanathan, Former Chief Justice of Meghalaya High Court residing at Old No.88, New No.7, Thirumangalam Road, Villivakkam, Chennai - 600049 as sole Arbitrator to enter upon the dispute between the parties. The learned Sole Arbitrator is entitled to fix his fees as per the Schedule-IV to the Act. This Court further requests the learned Sole Arbitrator to endeavour to decide the dispute as expeditiously as possible.
