O R D E R
The present criminal original petition has been filed to direct the respondent to register the complaint of the petitioner dated 31.10.2015 and to proceed in accordance with law.
2. The petitioner is residing at No.5B, 1st Street, Vetri Nagar, J.B. Estate, Avadi, Chennai - 600 054. The neighbour of the petitioner Kalavani is giving repeated threats to the family of the petitioner stating that she would throw away them from the property. On 01.7.2015, the son of the said Kalaivani and others trespassed into the house of the petitioner and abused her and threatened her with dire consequences. In this regard the petitioner gave a complaint before the respondent police. The respondent police also conducted enquiry on the complaint of the petitioner. Again on 31.10.2015, they trespassed in to the house of the petitioner and threatened the petitioner and his family members with dire consequences. Again the petitioner lodged a complaint before the respondent police on 01.11.2015. Though C.S.R.No.1447 of 2015 has been assigned, no action was taken on the said complaint till date. present Criminal Original Petition has been filed.
3. I have heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.
4. When the matter was taken up, the learned Additional Public Prosecutor submitted that on receipt of the complaint of the petitioner, C.S.R.No.1447 of 2015 has been assigned and enquiry was conducted and the same has been closed.
5. In view of the submissions made on either side, since the complaint given by the petitioner is enquired and closed, notiging survives in this petition and the Criminal Original Petition is dismissed. However, the petitioner is at liberty to work out his remedy under section 156(3) Cr.P.C., if he so desires.
6. This criminal original petition is disposed of accordingly.
