Writ Petition is filed under Article 226 of the Constitution of India, praying for the issue of a Writ of Mandamus, directing the respondents 1 to 3 not to permit the fourth respondent to open any retail outlet or issuing dealership to any person within the radius
of 1,000 meters distance of the petitioner's retail outlet situated at Deevanur Road, Vellimedupettai-604 207, Tindivanam Taluk, Villupuram District as per the Indian Road Congress guidelines by considering the representation of the petitioner dated 20.7.2015. For Petitioner : Mr.S.Vijayan For Respondents-1 to 3 : Mr.Roofus Abraham, Government Advocate.
O R D E R
The petitioner is the existing dealer with Indian Oil Corporation. Alleging that contrary to the Regulations, permission has been given to the fourth respondent to put up another retail outlet, an objection was raised by the petitioner to the second respondent not to consider the same.
2. Taking into consideration of the pendency of the representation of the petitioner dated 20.7.2015 and without going into the merits of the case, a direction is issued to the second respondent to dispose of the representation of the petitioner dated 20.7.2015 on merits and in accordance with law, more particularly the relevant guidelines governing the case, within a period of eights weeks from the date of receipt of a copy of this order, after affording opportunity of hearing to the petitioner as well as the fourth respondent.
3. The writ petition is disposed of on the above terms. No costs.
