3. The petitioner would aver that on account of the accident that occurred on 01.01.2015, he sustained serious injuries. He is a contract labour and is not in a position to go for work after the accident. He would further aver that due to financial constraints, delay of 862 days occurred in preferring the Civil Miscellaneous Appeal.

4. Accepting the averments made in the affidavit filed in support of this petition, this petition is allowed subject to the condition that the interest for the delay period of 229 days shall stand waived.
