Respondents Writ Petition is filed under Article 226 of the Constitution of India, praying for the issue of a Writ of Mandamus, directing the first respondent to dispose of the petitioner's second statutory appeal dated 12.8.2015.

O R D E R

The petitioner herein is the successful bidder of the quarrying lease granted by the third respondent as per proceedings dated 4.2.2011 to quarry rough-stone. In pursuant to the lease deed executed by the fourth respondent dated 4.2.2011 proceedings have been initiated. An order was passed by the third respondent giving appropriate direction with respect to the area of quarrying operation. The petitioner's further appeal to the second respondent was also rejected and thereafter the petitioner made further appeal to the first respondent on 12.8.2015. Seeking disposal of the same, the petitioner is before this Court.

2. It is seen that the appeal itself has been filed only recently viz., on 12.08.2015. Law mandates sufficient time has to be given to the Statutory Authority to consider the appeal.

3. Considering the facts and circumstances of the case, a direction is issued to the first respondent to dispose of the appeal of the petitioner within a period of three months from the date of receipt of a copy of this order. While doing so, the petitioner will have to be given an opportunity of personal hearing.

4. The writ petition is disposed of on the above terms. No costs.
